These Terms of Service (“Terms”) govern your access to and use of Tamable’s website and application (the “Service”), operated by Sparkling Opinions, Lda (“Tamable”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Who we are
The Service is operated by Sparkling Opinions, Lda, a company registered in Portugal (VAT PT517454483) with its registered office at Travessa Fonte do Bispo 17, 3030-243 Coimbra, Portugal. You can reach us at support@tamable.app.
The Service
Tamable keeps your ideas, blog posts and X posts in one place. AI assistants you connect can capture ideas and draft posts from your words; people in your workspace review them; Tamable then serves your published blog posts to your own website and posts your approved X posts to X. Tamable is human in the loop: only a person in your workspace approves or publishes. What a connected assistant can and cannot do is described on our Assistants and X access page.
Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for maintaining the security of your account, including the email address you sign in with, the personal keys you create and the assistants you connect, and for all activity that occurs under it. You agree to provide accurate information and to keep it up to date.
Workspaces
Content belongs to the workspace it is created in. A workspace’s owners decide who its members are and can delete the workspace and everything in it. Members can see and work on the workspace’s ideas and posts. If you invite someone, you are responsible for having the right to share the workspace’s content with them.
Assistants acting on your behalf
When you connect an AI assistant or create a personal key, you authorize that assistant to act in Tamable on your behalf, within the workspace it was approved for. Everything it does there is treated as done under your account, and these Terms apply to it as they apply to you. In particular:
- You are responsible for the assistants you connect and the instructions you give them, and for reviewing what they draft before you approve it.
- The assistant is your own and runs under your agreement with its provider. Tamable does not control, and is not responsible for, what the assistant or its provider does outside the Service.
- Keep personal keys secret. Anyone holding a key can act as you in Tamable. Revoke a key or disconnect an assistant in Settings › Assistants as soon as you no longer need it or suspect it has been exposed.
- Do not use an assistant, a key or any other automated means to get around the Service’s limits, to make decisions that only a person may make, or to access workspaces you are not a member of.
Your X account
Connecting an X account lets Tamable post to it on your behalf. Your use of X remains subject to X’s own terms, rules and policies, including its automation rules, and you are responsible for the content Tamable posts at your direction. Tamable posts only what a person in your workspace approved or scheduled, and posts a thread whole or not at all. Posts that have gone out on X stay on X: Tamable does not delete them later, and removing them is done on X. X may limit or change what it allows (for example, post length or media), and we cannot guarantee that X will accept a post. You can disconnect your X account at any time.
Your website
If you connect a site, your website reads your published blog posts with a read key and may be rebuilt through the deploy webhook you set. You are responsible for your website, its hosting, how it displays your content, and for keeping its read keys on the server side and out of anyone else’s hands.
Acceptable use
You agree not to, and not to let an assistant or anyone else acting for you:
- publish or store content that is unlawful, infringing, defamatory, harassing, hateful, deceptive, or that violates the rights or privacy of others;
- use the Service to send spam, to manipulate platforms (for example, fake engagement), or to impersonate others;
- violate X’s rules or any other platform’s terms through the Service;
- violate the rights of others or any applicable law or regulation;
- attempt to gain unauthorized access to the Service, its systems, or other people’s workspaces, or interfere with its operation, including by overloading it with automated requests;
- reverse engineer or misuse the Service except as permitted by law.
Your content
You retain all rights to your content: your ideas, posts and media. You grant us the limited rights necessary to host, process and transmit it in order to operate and provide the Service to you, including serving it to your website and posting it to X when you approve, as described in our Privacy Policy. You are responsible for having the rights to the content you and your assistants put into Tamable, including images imported from the web.
Free trial
New accounts may start with a free trial, for the length shown when you sign up. No payment details are needed for it. When the trial ends without a paid plan, your workspace becomes read-only: you can still read and export your content, and content you have already published stays published, but you cannot create, edit, approve or publish content until you choose a plan. Scheduled posts are held while the workspace is read-only. We may change or end the free trial for new accounts at any time.
Subscriptions and billing
Paid plans are billed in advance, monthly or yearly, through our payment processor (Stripe), and renew automatically at the end of each billing period until cancelled. You can cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period, and you keep paid features until then. Prices, plan details, the limits of each plan and any refund terms are shown before you subscribe. Posting to X is subject to fair use, so that a few accounts can’t degrade the Service or its costs for everyone. A discount from a promotion code applies for the period stated when you redeem it. Prices are exclusive of VAT; where VAT applies, it is calculated and added at checkout based on your location and, for business customers, your VAT registration status. Nothing here limits any statutory refund or withdrawal rights you may have as a consumer.
Intellectual property
The Service, including its software, design, and content (excluding your content), is owned by Sparkling Opinions, Lda and protected by intellectual property laws.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. Drafts written by an assistant may contain errors; you are responsible for reviewing any content before you approve or publish it. We do not guarantee that X, your website or your assistant’s provider will be available or will accept what Tamable sends them.
Limitation of liability
To the maximum extent permitted by law, Sparkling Opinions, Lda will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.
Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access, or disconnect an assistant, a key or an X account, if you violate these Terms or if necessary to protect the Service, other users or third parties. Upon termination, your right to use the Service ceases and we will handle your data as described in our Privacy Policy.
Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Governing law
These Terms are governed by the laws of Portugal, without regard to conflict of laws principles. The courts of Coimbra, Portugal will have exclusive jurisdiction over any dispute arising from these Terms or the Service, except where mandatory consumer protection law entitles you to bring proceedings in your own country of residence.
